These Terms & Conditions (“Terms”) govern your use of the Tended mobile application and related services (“Tended”, “the Service”, “we”, “our”, or “us”).
By creating an account or using Tended, you agree to these Terms and to our Privacy Policy.

2. Using Tended
You agree to use Tended respectfully, responsibly, and lawfully.
You must not:
- Upload illegal, abusive, harmful, fraudulent, or offensive content
- Use the Service to harass, impersonate, threaten, or exploit others
- Attempt to interfere with or disrupt the Service or its security
- Attempt to gain unauthorised access to accounts, systems, or data
- Upload viruses, malware, or harmful code
- Use the Service in a way that violates applicable laws or regulations
You are responsible for ensuring you have permission to provide steward or recipient contact information.

4. Legal Status of Tended
Tended is not a legal will, power of attorney, healthcare directive, or substitute for professional legal, medical, or financial advice.
The Service is intended to support organisation, communication, and personal planning only.
You are responsible for obtaining professional advice where appropriate.

5. Your Content
You retain ownership of the content you upload to Tended, including notes, documents, photos, videos, wishes, and messages.
By using the Service, you grant Tended a limited licence to store, process, transmit, display, and release your content as necessary to operate the Service according to your settings and instructions.
You are responsible for the legality, accuracy, and appropriateness of the content you upload.

6. Stewards, Recipients & Release of Information
Users may appoint stewards and recipients within the Service.
Tended may rely on confirmations or actions provided by appointed stewards and does not independently verify all decisions, circumstances, or information submitted by users or stewards.
- If death is confirmed, content designated for release may be shared with selected recipients or stewards
- If incapacitation settings are enabled, limited practical Vault information may be made accessible to authorised stewards
- Emotional or posthumous messages remain protected until death is later confirmed, unless otherwise configured by the account holder
Tended reserves the right to delay, restrict, review, or refuse release of information where fraud, misuse, disputes, security concerns, or legal issues are suspected.

7. Subscriptions & Billing
Some features of Tended may require a paid subscription.
Subscriptions renew automatically unless cancelled through your Apple App Store or Google Play account settings.
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.
Refunds are handled according to Apple App Store or Google Play policies.
We may change subscription pricing or features from time to time. Where appropriate, we will provide reasonable notice of material changes.

8. Service Availability
We aim to provide reliable access to the Service but cannot guarantee uninterrupted, secure, or error-free operation at all times.
Features, functionality, or availability may change, be suspended, or be discontinued from time to time without notice.
Tended is provided on an “as available” basis.

You are responsible for maintaining the security of your account, device, login credentials, PINs, and authentication methods.

10. Account Suspension & Termination
We may suspend, restrict, or terminate accounts where we reasonably believe:
- These Terms have been violated
- The Service is being misused
- Fraudulent, illegal, or harmful activity has occurred
- Security risks exist
- We are required to do so by law
You may stop using the Service or request account deletion at any time.

11. Data & Account Deletion
You may delete content or request deletion of your account through the Service or by contacting us.
We aim to remove personal data within a reasonable period following deletion requests, subject to legal, operational, security, backup, or fraud prevention requirements.
Certain information already released to authorised stewards or recipients may remain accessible to those users.

12. Intellectual Property
Tended and all related software, branding, designs, graphics, text, logos, and features remain the property of Tended App Limited or its licensors.
You may not copy, modify, distribute, reverse-engineer, reproduce, resell, or exploit any part of the Service without prior written permission.

13. Emergency Services Disclaimer
Tended is not an emergency service and should not be relied upon for urgent medical, legal, financial, or emergency communications.
Users should ensure they maintain appropriate emergency contacts and legal arrangements outside the Service.

14. Limitation of Liability
To the fullest extent permitted by applicable law, Tended shall not be liable for:
- Decisions or actions taken by users, stewards, or recipients
- Loss of data, access, or content
- Delays or failures in message delivery
- Indirect, incidental, emotional, consequential, or special damages arising from use of the Service
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

15. SMS Messaging Terms
If you provide your mobile number and opt in, Tended App Limited may send you SMS messages for:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
